Welcome to Post Hype, a web application designed to help you generate viral tweets using AI and schedule them for your social media accounts. These Terms and Conditions ("Terms") govern your access to and use of the Post Hype website, services, and applications (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
By creating an account, accessing, or using the Post Hype Service, you signify your agreement to these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Service.
You must be at least 18 years old to use the Post Hype Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
a. Account Creation: To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. Account Confidentiality: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify Post Hype immediately of any unauthorized use of your account or any other breach of security. Post Hype will not be liable for any loss or damage arising from your failure to comply with this section.
c. Twitter Account Connection: For tweet scheduling to function, you must connect your Twitter account(s) to Post Hype through our dashboard. By connecting your Twitter account, you grant Post Hype authorization to access and interact with your Twitter account(s) solely for the purpose of scheduling and publishing tweets on your behalf, as per your instructions within the Service. You understand that this connection may involve granting Post Hype certain permissions as outlined by Twitter's API. You can revoke this access at any time through your Twitter settings or by disconnecting your account within the Post Hype dashboard. Post Hype is not responsible for any actions taken on your Twitter account by you or third parties outside of the Post Hype Service.
a. AI Tweet Generation: Post Hype provides an AI-powered tool to generate tweet content. While we strive to provide relevant and engaging content, we do not guarantee the virality, accuracy, or suitability of generated tweets for your specific needs or audience. You are solely responsible for reviewing and editing all generated content before publishing.
b. Tweet Scheduling: The Service allows you to schedule tweets to be published on your connected Twitter accounts. Tweet scheduling will only function when your Twitter account is successfully connected to Post Hype. We endeavor to publish scheduled tweets at the designated times, but we do not guarantee exact timing due to potential technical issues, Twitter API limitations, or other unforeseen circumstances.
c. Responsible Use: You agree to use the Service in a responsible and lawful manner, and in compliance with these Terms, all applicable laws and regulations, and Twitter's Terms of Service. You will not use the Service to:
a. Post Hype Content: All content, features, and functionality on the Post Hype Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Post Hype or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
b. User-Generated Content: You retain all ownership rights to the content you create and publish through the Post Hype Service. By using the Service, you grant Post Hype a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content you generate and publish solely for the purpose of operating and providing the Service.
a. Subscription Plans: Access to certain features of the Service may require a paid subscription. Details of our subscription plans, including pricing and features, are available on the Post Hype website.
b. Billing: By subscribing to a paid plan, you agree to pay the applicable fees. All payments are processed through secure third-party payment processors. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
c. Refunds: All fees are generally non-refundable unless otherwise stated in a specific promotion or as required by applicable law.
a. By You: You may terminate your Post Hype account at any time by following the instructions within the Service. Upon termination, you will no longer have access to your account and any associated data.
b. By Post Hype: Post Hype may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. POST HYPE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT SHALL POST HYPE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
You agree to defend, indemnify and hold harmless Post Hype and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) content posted by you on the Service.
These Terms shall be governed and construed in accordance with the laws of [Your Country/State - e.g., India, or State of California, USA] without regard to its conflict of law provisions.
